test2.png Anybody notice this? Green Hylotl roleplaying will happen.
EDIT: I am aware that this is a mockup, but it still could be ingame.

Those icons are concept art from the predevelopment stage. Chances of them still being in are slim.

Maybe they're using them for some MoCap for greater in-game verisimilitude in character movements. Just like these guys:

And why NOT have them in-game? If they've already done the artwork, make up some non-game-breaking stats and throw them in. Or make them vanity items. Why not?

Because they will almost certainly be sued. Looks WAY too much like the TMNTs.

Have you seen the pixelhero armor in that one stream? It looks exactly like superman.

I sincerely doubt they would be sued unless they used a name that sounded like TMNT. They could call it "Reptilian Armor" or "Samurai Tortoise Suit" or just "Green Costume." There's a Bob-omb in there, but I doubt Nintendo will sue as long as they just call it "Anthropomorphic Explosive." Or even better "Rob Bombie."

There's got to be a line they can cross to go from "copyright infringement" to "loving homage." For example, could German advertising agency Jung von Matt get sued for this:

I dunno. I think an indie game like Starbound could fly under the radar as long as they're careful. But I'm no lawyer.

I'm pretty sure as long as you call them something else it'll be fine and they won't be sued.

    I mean look at this

as long as its 30 percent different from the original, then it's apparently fine. If that iphone app can get away with just BLATENTLY blatentetnententently super crazy blatently stealing like all of the Pokemon and even Mario sounds, I am sure Starbound will be fine

Eh, I dunno. There's a level of inconsistency with things like this. They could be sued, and I get the feeling that if they went to court, it would not end in their favor. However, they could also be completely ignored. There's no real way to tell.

First of all you can't win a law suite or get a copywrite for sounds of 1-2 seconds like the Mario jump sound.
Anyone can use short samples like this (no I'm not going to reference the legal writing).
Second, precedent in successful lawsuits involving infringement of copywrite have been against companies or people who have blatantly used an image or sound to sell something.
That is why marketing has to be very careful about what they use. Unmarketed cameos are generally safe and have been used a lot so there is a kind of precedent in the industry.
So I would say if TMNT armor was an Easter Egg in the game somewhere it would most likely by OK. I'm not a lawyer though.

Everyone itt talking about lawsuits: Did you see the Plumber/Heroes outfit from terraria? Literally looked exactly like Mario/Link except they didn't have any legal trouble at all.

Starbound would be fine if they include it as long as they don't literally come out and say like, "Donatello suit".
