I can be patient for my 2013 beta access but at midnight on December 31st that patience is going to run out for obvious reasons.

To buy doesn't mean entitlement as in you have all rights to starbound but rather you have the privilege of using one. It cannot be distributed. If the seller fails to give the product, the buyer has the right to bring him to court (Though you can actually get a refund from CF) for charges of fraud.

Legally speaking, Chuckle fish could probably take as long as they liked since there were no set conditions for the date of release.

Forgive me if I'm wrong anywhere, I simply aspire to be a prosecutor, I have no actual experience in law. Well I have played Phoenix Wright before...

Kickstarter self-identifies as funding, the Starbound pre-order self-identifies as a purchase, significant difference.

 

It's actually getting to a point where people don't know who they are arguing against.
