They delayed full release that was supposed to be in 2013 no matter what. Yes, that includes "no matter if we will still have this save bug". What makes you think they won't delay beta as well?

Yes I bought it and if I won't get it by Jan 1st 2014, I won't get a refund. I'll go straight into UK court and sue CF into oblivion.

Not a thing, so far. That is the joke. Also watch out for double posting, that will land you in trouble. Edit your responses together rather then double.

Edit: Also just.. no. Sue? Just no. If after Jan1st, go for a refund sure.. but unless they refuse it, why?
It sure wouldn't help them improve. Nobody gains anything in that situation.

I don't see that one going over well:
Darkhog: "Your honor, I paid for this game, and CHucklefish did not deliver on time!"
    Judge: "Is this accurate?"
CF Rep: "Yes, your honor. We haven't completed the game yet, but we've offered easy refunds for anyone that would like to withdraw their investment."
Judge: "So, Mr Darkhog... you're wasting thousands of dollars in lawyer fees and my time to demand your $15 dollars back, after CF freely offered you a refund?"
Darkhog: "It's the principle of the matter."
    Judge: "Case dismissed."

What a terrible waste of time and resources that would be =/ On the bright side, I've never known someone who screams "I'll sue" on a forum to actually put in the time, effort, and money it takes to do so.

Except if he wins the lawsuit which means that he, you know, gains money.

Well okay yeah, cash if he won. I think everyone else would lose out if Starbound was shelved or canceled over it though.
I don't know about you.. but I want them to improve and get on the ball, not get dragged down in legal fees and lawyers.

    That would just.. suck.

Chances are it would be cheaper for Chucklefish to settle out of court, if they took that route, he'd gain money and no time or resources would be wasted.

You know i agree with just about everything you said in that post.

    However, there is one problem.

No matter what is said on this particular thread will be acted upon, why ? because the devs do not read this thread or at least not in very great detail, the main staff you will see monitoring this thread is mod's and they are here just to keep the peace.

So although what you said had many great points most of it has probably gone on deaf ears, and i might add there us little that can be done about that as other threads are deleted or locked.
So in short what has happened here is that the devs or basically ignoring this thread so they can turn a blind eye to it and hope eventually it will all go away upon release of the beta, so i guess what im saying is we are all wasting our time even entertaining this thread apart from just sitting behind our keyboards throwing theories at each other for no reason in the hope that a dev may decide to pay attention to what we have to say (which they wont as they have there deadlines that is shared between the team only).

The only real impact (If any) will come from contacting them directly either by sending a direct message on here which is private and no one can see it to back them up or via email which also has the same problem.

So why are people still arguing on this thread its a total waste of time and forum space particularly on a thread that does not get any recognition what so ever by the team.

    P.S

To everyone that reads this post, think about what i have said, and apologies for my bad grammer :p

Nobody knows, probably including the devs themselves, and definitely not the posters who've previously answered this, as they are all biased against the devs and don't believe anything the devs say.
You don't automatically get drowned in cash by suing someone, even if you win. You generally have to prove that you have suffered damage as a result of the sued party failing to deliver. The popular reason people sue is over 'pain and suffering' caused by the other party. Good luck on getting a judge to agree that you have suffered substantially over a delayed game.
Actually, the question should be "what do you know about running and managing Starbound."

The answer is, unless you are in Tiy's shoes, and know everything Tiy knows, not much at all. Even if you have all the experience and knowledge of other major projects.

If you can sue a clothing store for 80K$ for breaking your ankle after tripping over your own kid in it and WIN i would not be surprised.

  11. Calris

    Calris Existential Complex

Regardless of the merits of the case, there is a broken ankle to point to for evidence of damage. Once again, good luck convincing a judge of substantial damage caused by a game failing to deliver on time (or at all, for that matter.)

He wouldn't even have a case. It would cost CF next to nothing to go to a preliminary hearing where the case would be thrown out. The judge would possibly order them to give him his $15 back, but even that is a stretch, as they have already made that option available to him. Unless he requests the refund and they refuse, it's just a waste of everyone's time to bring the legal system into it.

Was it a large company with lots of money? 80k would be pocket change to someone like Walmart. They could win the case, but every day their name is in the papers it makes them look bad, potentially costing them millions. I don't think settlements like that are right, but they tend to happen because the cost-benefit analysis says they'll lose less money by settling. Chucklefish would have no such incentive since they don't have gobs of extra money, and it would set a horrible precedent, allowing every person who had preordered to engage in a class action lawsuit.

Hundreds. I cant see something so small ever breaching a thousand.

In reality, zero. You have no grounds to sue.

Why are you arguing with me as if I had any interest in taking CF to court
All I'm saying is that considering the kinds of legal crap that flies these days you never know.

It wouldn't hold in court, there's no loss of value to any extend that would actually benefit, you, at most the cost of the trial and estimated loss of value of the product (% of 15$) would be what you'd could possible get out of it.
who in their right mind would go to court for what 3-4$ ?.

as it has to physically affect you in a way that can be calculated, the closest comparison would be the loss of value based on the purchase price, for you, in term delay causes the product to hold less value, thus you could probably gain a discount at best, or rather return of a portion of the cost. at least that's how it would end up in court in my country, i cant say for yours.

Xander: Kinda hard to taint future projects especially when they haven't finished the current one. When it is all said and done then maybe you could get a semi accurate measure of their reputation after the fact.

Starbound hasn't even been in development for a full two years. And again far worse screw ups have been made by other companies and their reputations and futures survived just fine. It wasn't meant as a sideline I was giving you some benefit of the doubt that I might be misinterpretting what you are trying to say. You know something that happens very frequently in conversation online.

When i say "legal crap" this does not entail anyone winning. Just look at the Hanfree guy from kickstarter, the lawsuit was dropped and he still got financially ruined.

So mods now harass members or do you fix the grammer in every post? What is the point? I also don't understand why the picture above my post is not cut out too because of the size. And btw, sorry for my grammer, i think i would beat you up in german or russian or ukrainian grammer. Starbounds customers are not only from countries in which english is the native language.

So obvious selective and pathetic harassment:

    1. You do not fix grammer in each post, this means you jerked me.
    2. Just a post above, same picture size => not removed and not mentioned to cut.

I'm open for an explanation why i'm wrong with this. Everythign else is treated as "yes we harass everyone with wrong mindset, we help fans "beat up" everyone who does not follow the stream we point".

And just to note. I make screenshot of everything i post in such cencored and biased environments. I just document everything and so it will be posted in every possible community and shared, if it just get removed. because what you see here is obvious.

The title fanboy was earned by trolling at a feedback. A long post which was sure an effort to write. Such a disrespect. Where were the mods at that point? Watching away. Its just pathetic to realise this.

Haha this entire thread is an absolute joke......I really hope beta is released soon just so this thread will have no point to it at all.........OH WAIT!! it already is pointless........

On a serious note though why argue with each other over this issue what will it solve..........none of you are clearly getting anywhere apart from winding each other up and last time i checked this forum was not designed to be a keyboard warrior fight club.
